Terms of use

These terms govern your use of Korbel, the website at korbelapp.com and its related services (together, “Korbel”, “we”, “us”). By using Korbel or creating an account, you agree to these terms. If you are using Korbel on behalf of a company, you confirm you are authorised to accept these terms for that company, and “you” includes that company.

1. What Korbel is

Korbel is a database of buildings and infrastructure projects in New Zealand. It shows the companies that designed and built each project and the products used on it. Companies can create a page, list products and claim their role or products on projects: a number of claims free (three, unless we set a different number for an account), and any number with a subscription. Claims are reviewed before they are published.

Korbel also publishes discoveries: early information about proposed work, drawn from public records such as government tenders, council resource consents and Overseas Investment Office decisions.

2. Accounts

• Accounts are for businesses. Each account represents one company, and the account holder must be able to act for that company.
• You must give accurate information when you register and keep it up to date.
• You choose an account type (professional services, contractor / trade, or product company) when you register. It decides what you can claim and cannot be changed by you afterwards.
• You are responsible for keeping your login details secure and for everything done through your account. Tell us straight away at team@korbelapp.com if you think your account has been misused.

3. Approval and verification

We review new accounts, products and claims before they appear publicly. We may approve, decline, edit, suspend or remove any account, page, product or claim at our discretion, including where we cannot verify it or believe it is inaccurate. Approval is not an endorsement of your company, products or work.

4. Subscriptions and payment

• Approved accounts can make a number of claims for free: three, unless we set a different number for your account. One claim is one role on a project, or one product on a project. Pending and approved claims count towards your free claims; rejected claims do not.
• Making more claims than your free claims requires an active subscription. Subscriptions are billed monthly in advance at the price shown when you subscribe.
• Payments are processed by our payment provider, Stripe. We do not see or store your full card details.
• Your subscription renews automatically each month until you cancel. You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
• Fees are non-refundable, including for partly used periods, except where the law requires otherwise.
• We may change subscription prices. We will tell you before a new price applies to you, and you can cancel before it takes effect.
• We may offer complimentary subscriptions at our discretion and may end them at any time.
• If your subscription ends, your free claims (your earliest ones, by the date you made them) stay visible. Your other claims stay in our records but are hidden from project pages until you subscribe again. If your account is no longer approved, your company page, products and claims are hidden in the same way.

5. Your claims and content

• Only claim roles you genuinely performed and products that were genuinely used on a project.
• You are responsible for the content you submit, including your company details, descriptions, logos, product information and images.
• You confirm you own the content you submit or have permission to use it, and that it does not infringe anyone's rights or break any law.
• You grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize, display and publish your content on Korbel and in promoting Korbel, for as long as it is on Korbel and for a reasonable period afterwards.
• We may edit content for formatting, accuracy or length, and may remove content at any time.

6. Acceptable use

You must not:

• submit false, misleading or deceptive information, including false claims of involvement in a project;
• impersonate another person or company, or register an account for a company you do not represent;
• copy, scrape or harvest data from Korbel by automated means, or build a competing database from it, without our written permission (indexing by public search engines is allowed);
• interfere with, overload or try to gain unauthorised access to Korbel, its systems or other accounts;
• upload malicious code, spam, or content that is unlawful, offensive or infringing; or
• use Korbel in a way that breaks any law, including the Fair Trading Act 1986.

7. Project and discovery information

Project and discovery information on Korbel comes from public sources and from the companies that use Korbel. We work to keep it accurate but do not guarantee that it is complete, current or correct. It is general information only and is not professional, technical or procurement advice. Check anything important independently before relying on it. Discoveries describe proposed work, which may change, be delayed or not go ahead. To ask for a correction, email team@korbelapp.com.

8. Our intellectual property

Korbel's design, software, branding and the way information is compiled and presented belong to us or our licensors. You may view and share Korbel pages for normal business purposes. You may not reproduce, resell or redistribute Korbel content in bulk without our written permission.

9. Third-party services

Korbel relies on third-party services, including hosting, database, payment, email and analytics providers, and links to external websites. We are not responsible for third-party websites or services, which have their own terms.

10. Business use and consumer law

Korbel is provided to businesses for business purposes. To the extent permitted by law, the Consumer Guarantees Act 1993 does not apply, and you agree it is fair and reasonable for the parties to contract out of sections 9, 12A and 13 of the Fair Trading Act 1986. Nothing in these terms limits any right that cannot lawfully be excluded.

11. Disclaimers

Korbel is provided “as is” and “as available”. To the extent permitted by law, we make no warranties about Korbel, including that it will be uninterrupted, error-free or secure, or that any information on it is accurate.

12. Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, opportunity, data or goodwill, however caused. Our total liability to you for all claims relating to Korbel is limited to the subscription fees you paid us in the 12 months before the event giving rise to the claim.

13. Indemnity

You agree to indemnify us against any loss, cost or liability arising from content you submit, claims you make, or your breach of these terms or the law.

14. Suspension and termination

You may stop using Korbel and ask us to close your account at any time by emailing team@korbelapp.com. We may suspend or close your account, or remove any content, if you breach these terms or if we reasonably believe it is necessary to protect Korbel, its users or others. Sections that by their nature should continue after closure, including sections 5, 7 and 10 to 13, continue to apply.

15. Changes

We may change Korbel or these terms from time to time. We will post the updated terms on this page with a new effective date and, for significant changes, notify account holders by email. Continuing to use Korbel after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction.
